Anhui Province: Establishing The Third Party Evaluation Mechanism Of Legal Aid Case Quality

Reporters from the provincial people's Congress Standing Committee held a press conference on local laws and regulations, was informed that the newly revised "Anhui Provincial Legal Aid Ordinance" has been approved by the thirty-fourth session of the twelve Standing Committee of the people's Congress, and will take effect from January 1, 2017.

The new regulation clearly states that legal aid is the responsibility of the government, and the people's governments at all levels should include legal aid in the basic public service system.

The people's governments at or above the county level shall include the requirements for legal aid in the same level financial budgets, arrange funds according to the local financial resources and the number of cases handled, and the funds shall be earmarked for special purposes, subject to supervision by the financial and auditing departments.

The Legal Aid Ordinance was enacted in 2002 and revised in 2009.

The newly revised regulations conform to the requirements of the development of the situation, carry out the concept of shared development, focus on the new situations and problems in the practice of legal aid, refine the system standard, expand the scope of assistance, clarify the standard of economic hardship and the subsidy standard of case aid, create the third party evaluation mechanism of legal aid case quality, and further strengthen the legal protection of our province's legal aid work.

Expanding the scope of legal aid is the trend and requirement of reforming and perfecting the legal aid system.

The new regulations will be incorporated into personal injury and property loss related to traffic, industrial injury, medical treatment, food and drug, environmental pollution and product liability accidents, and the legitimate rights and interests of rural land contracted operations and their circulation, and damage caused by high-risk operations.

The scope of the matter and authorized municipalities can provide supplementary provisions to further expand the scope of legal aid coverage.

The new regulations also lowered the threshold for legal aid applications, and the economy that applied for legal aid.

At the same time, the people's government at or above the county level can be authorized to expand the scope of the recipient in accordance with the actual situation in the administrative region, and the people's government above the county level can be extended to two times the minimum standard of living security.

The quality of legal aid is related to the vital interests and physical and mental feelings of the difficult people.

According to the new regulations, the judicial administration departments of people's governments at or above the county level should take appropriate forms to assess the quality of legal aid cases.

The assessment results should not only be disclosed to the public, but also serve as the basis for the annual assessment of law firms, grass-roots legal service centers, lawyers and grass-roots legal service workers.

In order to improve the scientificity and impartiality of the evaluation, the new regulations create the third party evaluation mechanism for the quality of legal aid cases creatively, and put forward the "implementation of the third party evaluation agency to evaluate the quality of legal aid cases".
