DP Trademark Registered YOUNGOR Is Accused Of Durable Ironing Label Infringement

 DP trademark registered YOUNGOR is accused of durable ironing label infringement

Domestic clothing giant YOUNGOR (600177.SH) has some bad luck.

Recently, Mr. Li, a private enterprise worker in Wuhan, brought YOUNGOR to the second intermediate people's Court of Beijing on the grounds of infringement of trademark rights, claiming a sum of 10 million yuan.

The trouble is YOUNGOR's ironing shirt, which was launched two years ago by YOUNGOR. Mr. Zhang Chao, the Attorney General of Mr. Li and Guangsheng law firm of Beijing, told the first Financial Daily yesterday that Mr. Li received the trademark registration qualification of "DP" in the name of "DP" in 2003. Therefore, YOUNGOR clearly used the DP word in the trademark to constitute the infringement fact.

He said that at present, the second middle court of Beijing has accepted the case, and the next step will arrange the time to collect evidence from both sides.

Chen Zhidong, general manager of YOUNGOR clothing company, told reporters yesterday that YOUNGOR never used "DP" as a trademark. The plaintiff's lawsuit was "illogical".

He said YOUNGOR had consulted some local legal institutions, which supported his views.

Chen Zhidong said, "DP" is the abbreviation of "Durable Press (durable ironing)" and is the most advanced anti wrinkle finishing technology in the international market, and only one YOUNGOR family owns in the domestic market.

The main reason for marking "DP" is to remind consumers to pay attention to the quality of this kind of clothing. It is a product continuation of YOUNGOR's "HP" and "VP" series launched ten years ago.

Zhang Chao also admitted that "DP" is a technical term in the clothing industry, but he said that the current domestic legal system does not stipulate that the abbreviation of terminology can not be registered as a trademark.

"It can be said that it is a coincidence that the trademark registered by my client is just used by YOUNGOR's clothing brand."

Zhang Chao said that since he contacted YOUNGOR in May this year, he felt the other side's attitude was "very tough".

Zhang Chao said that some experts and scholars in Beijing also believed that YOUNGOR was guilty of infringement. He believed that the plaintiff would be more likely to win the lawsuit, but the amount of compensation would probably be less than 10 million yuan.

Yesterday, YOUNGOR shares rose 5.72% to 10.90 yuan.
